Admissibility of FMRI
Functional magnetic resonance imaging, or FMRI, is a technique for measuring brain activity. It works by detecting the changes in blood oxygenation and flow that occur in response to neural activity ââ¬â when a brain area is more active it consumes more oxygen and to meet this increased demand blood flow increases to the active area.FMRI can be used to produce activation maps showing which parts of the brain are involved in a particular mental process (FMRIB Center).This is how it works: oxygen is delivered to neurons by haemoglobin in capillary red blood cells. When neuronal activity increases there is an increased demand for oxygen and the local response is an increase in blood flow to regions of increased neural activity.Haemoglobin is diamagnetic when oxygenated but paramagnetic when deoxygenated. This difference in magnetic properties leads to small differences in the MR signal of blood depending on the degree of oxygenation.Since blood oxygenation varies according to the le vels of neural activity these differences can be used to detect brain activity. This form of MRI is known as blood oxygenation level dependent (BOLD) imaging (id).It is claimed that through this process, FMRI can be used as a lie detector test. The question now arises that should the FMRI be used as a lie detector test, will the results be admissible in evidence in our courts of law in light of the Daubert ruling? This paper will try to answer this question by testing FMRI against the four questions set up by the Supreme Court in the said decision.Is FMRI a testable technique?The Supreme Court, in discussing how evidence should pass this test, the judge must ascertain whether the reasoning or methodology underlying the testimony is scientifically valid and of whether that reasoning or methodology properly can be applied to the facts in issue.A key question to be answered in determining whether a theory or technique is scientific knowledge that will assist the trier of fact will be w hether it can be(and has been) tested (92-102). The main concern of the Supreme Court here is the reliability of the technique and reduction of falsifiability.FMRI is one of the most recently developed forms of neuroimaging but the idea underpinning the technique ââ¬â inferring brain activity by measuring changes in blood flow ââ¬â is not new (FMRIB Center). The technique, however, is relatively new.FMRI still has not gained acceptance as a reliable method of lie detection to replace the polygraph. Recent studies only indicate that FMRI may be more reliable than the polygraph but FMRI is yet to attain its full potential.Dr. Faro, in studying FMRI admits that because the polygraph test, while improved over the last 10 to 15 years, is not as accurate as it needs to be, a better method for detecting deception clearly needs to be developed (Orenstein 30).He add that he is convinced that FMRI used with or without polygraph will someday be the new gold standard (id). The scientist s remain hopeful the FMRI will someday be the standard. But as of today, its acceptability as a lie detection test is still on a thin balance. In short, FMRI has not yet been fully tested so as to be acceptable as a lie detection method.Despite this, it is noteworthy that FMRI lie detection centers have already been set up in the United States. They are No Lie MRI, Incorporated and Cephos Corporation. This shows that FMRI is gaining ground as a stand alone test for lie detection and not just merely as a supplement to the polygraph.Has FMRI been peer reviewed?à The concern of the Supreme Court in including this test is to make sure that the theory or technique has been subjected to scrutiny by the science community because it is only then that the substantive flaws of the methodology can be revealed.Without effort, FMRI will pass this test. FMRI has been subjected to tests and retests by a lot of scientists to verify its efficiency and effectiveness. In fact the University of Oxfor d established its own FMRIB Center to study it as a field of discipline.As mentioned earlier, Dr. Faro already tested whether it can replace the polygraph or not. And lastly, there are also plenty of studies on FMRI being conducted as of this moment because it has inspired general interest in the science community. The abstracts of these studies can be viewed in the internet.Does FMRI have a known error rate or standard controlling it operation?The error rate of FMRI has not yet been established because as mentioned earlier, it is a recent development in nueroimaging and still has not been tested thoroughly. However, Dr. Faro says that subjects would have to lie perfectly for them to beat the FMRI (Orenstein, id).He says that FMRI would be much harder to beat than polygraph because it measures a primary cognitive response that begins within the deep structures of the brain.Lying involves coordinating complex activations in many different parts of the brain that relate to awareness, understanding, inhibition, and emotion.One way of arguing the admissibility of the FMRI according to this test is to argue how polygraphs are admissible in courts. According to the American Polygraph Association, polygraph results are admissible in some federal circuits and states (Orenstein, id).And this is so even though the polygraph is only 85% to 90% accurate when the subjects are being deceptive and only 70% to 75% accurate when subjects are being truthful. If polygraphs are admissible in court, then FMRI should also be admissible considering that the latter is more accurate than the former.However, there is a great cloud over the admissibility of the FMRI when the procedure of conducting it is considered. Subjects participating in a fMRI experiment are asked to lie still and are usually restrained with soft pads to prevent small motions from disturbing measurements.It is possible to correct for some amount of head movement with post-processing of the data, but large transient motion can render these attempts futile. Generally motion in excess of 3 millimeters will result in unusable data.Thus, a very accurate data is hard to obtain from FMRI. A movement of only 3 millimeters will already render the data useless. Considering that the shortest time needed to conduct an FMRI is 15 minutes, it is easy to conclude that an FMRI is hardly accurate.Of course, this can be addressed by utilizing mechanisms to reduce movements. And the FMRI centers should have already addressed this problem. But standing as it is, this fact casts doubt on the admissibility of FMRI because of the possible large inaccurcies of the data gathered during testing.There is also a concern on the reliability of the FMRI with regard to complex lies. Complex lies are half truths and sometimes rhetorical answers to the standard questions asked during an FMRI session. They are answers which have shades of truth or just an answer with a misperception about a question. This area of FMRI still ha s not been studied thoroughly making it less reliable as a method of lie detection.Is the underlying science generally accepted?Yes, the underlying science behind FMRI is generally accepted. As mentioned earlier, the idea underpinning the technique (FMRI) ââ¬â inferring brain activity by measuring changes in blood flow ââ¬â is not new. The study of FMRI draws from physics, psychology, neuroanatomy, statistics and electrophysiology, all of which are generally accepted fields of discipline. Thus, under this test, FMRI is admissible in evidence.ConclusionIn conclusion, FMRI is not admissible in evidence when tested against the Daubert standards. First of all, it still has not been thoroughly tested as a science. The method of conducting has not yet been perfected by the testing centers. These two factors accounts for somewhat doubtful results and may seem not convincing before the eyes of the courts.In fact, criticisms as to the accuracy of the data gathered during FMRI have al ways been the the biggest factors in sustaining its non-acceptability. Issues raised such as there are non-neural influences in the change of magnetic fields in the blood vessels have been raised and these have not been specifically addressed by the current studies on FMRI.It has also been raised that FMRI only measures the secondary physiological correlates of neural activity, it is not a direct measure. This means it is not a truly quantitative measure of mental activity ââ¬â when comparing the FMRI response between individuals it is impossible to say whether the differences are neural or physiological in origin (FMRIB Center).These are the scientific arguments against the FMRI. Of course, there are also ethical arguments against its use but they will not be discussed in this paper for being irrelevant.One argument which, to the mind of this reader, will really cause the courts to strike down FMRI evidence as inadmissible is the constitutional argument that it violates the rig ht to privacy. During an FMRI session, collateral information about the subject may be obtained but which he would have wanted to keep secret. This is a violation of the right to privacy.à Of course, it is already established that such a mechanical method of subjecting one's self to physical examination is not violative of the right against self-incrimination. However, this is not the case I am pointing out. What if some information not related to the trial or to the case has been obtained during the FMRI session?True that it will not be offered in evidence but the damage of violating the right to privacy has already been incurred. What will the subject do then? If the FMRI violates the constitutional right to privacy, then anything obtained during such sessions, though irrelevant and immaterial to the case, should be kept confidential and inadmissible in evidence in all courts and tribunals.Secondly, the FMRI should be inadmissible in evidence because its error rate still has not been determined to a certain definitive degree. It matters not if polygraph evidence is admissible in many federal and state courts. As of the moment, the Supreme Court still has no definitive ruling as to its admissibility (Orenstein).Moreover, the accuracy of the data obtained during FMRI sessions is still in doubt when the procedure is considered. The fact that a 3-millimeter movement will render the data untruthful is enough for the courts to cast a doubtful eye on FMRI evidence. As to the matter of complex lies, this provides the subjects a way to beat the FMRI.They even do not have to lie. They can just answer half-truths or even use rhetorical answers and they could already beat the FMRI.All these point to rejection of FMRI evidence considering the attitude of the courts toward the Daubert principle. In fact, litigants say that courts are more strict than what the Supreme Court suggested in the Daubert case (Hileman 2003).However, as a statement of hope for FMRI, today is no t the timely moment to test its admissibility in our courts of law. It should be given more time to develop into a better-founded discipline and its loopholes tied end-to-end. What are the weaknesses of mass marketing, as opposed to segmented marketing? What advantages does a company gain from market segmentation, as opposed to treating the market as single entity? MASS MARKETING:- Mass marketing is a market strategy in which firm or industry treat market with single offer or one strategy. In this marketing term wide range of customers and audience are concentrated. As there is no segmentation and focusing concern so large amount of customers are possibly exposed to the product.For example as audience is focused on radio, television and newspapers in which large and broad audience are targeted by the companies and industries towards their product. Mass marketing is the opposite of segmented marketing as it focuses on high sales and low prices. Mass marketing aims is to provide services and products that will appeal to the whole market. Segmented marketing targeted a specific or particular segment of the market for example specialized services or goods with few or no competitors.WEAKNESSES OF MASS MARKETING AS OPPOSED TO SEGMENT MARKETING:- Mass marketing focus to produce one type of goods and services to consumers, it is possible to reduce the level of risk involved in implementing this marketing term by market research although there is always a danger that demand for the product may fall. To determine any risks that may occur, a business must continuously examine the life cycle of their products and to analyze their product portfolios, this should ensure that the business goods continue to satisfy the market. The high cost of fixed capital costs that are incurred may prevent many businesses from operating a market. * Developing a product that would appeal to a mass market is difficult as it must appeal to all customers. Appealing to individual customers would be very challenging for the business. * Businesses in mass marketing can be defenseless to fluctuations in demand. A decrease in demand would lead to unused spare capacity tha t would effectively increase the unit cost per product. SEGMENTATION:- Market segmentation is the concept in which markets certain group or people are targeted and focused.Researcher has shown that racial similarity, role congruence, labeling intensity of ethnic identification, shared knowledge and ethnic salience all promote positive effects on the targeted market. In market segmented we have seen that their customers and consumers are loyal and strongly affinity to the particular brand or product. As in market segmenting the market is divided into individual markets with similar wants and needs as on the products consumption. Broadly markets can be divided according to a number of general criteria, such as by industry or public versus private.Although there is difference in industrial and consumer market segmentation but both of them have similar objectives. Why segmentation? One of the main reasons for using market segmentation is to help companies to better understand the needs of a specific customer base. Mass marketing assumes that all customers are the same and will respond to the same advertising. By looking at ways in which potential customer groups are different from each other, the marketing message can be better targeted to the needs and wants of those people.Often. Dividing consumers by clearly defined criteria will help the company identify other applications for their products that may not have been obvious before. These revelations often help the company target a larger audience in that same demographic classification, improving market share among a specific base. Segmenting the market can also serve to identify smaller groups of people who make up their own, previously unknown subsets. SEGMENTATION OR SINGLE ENTITY MARKET:-Segmentation is much more valuable market strategy as compare to the market as a single unit because itââ¬â¢s much more hard and difficult to focus and know about the demands and needs of, customers and consumers if they are spread in a larger quantity. Market as a whole is difficult to handle if the areas of it are specifically are not defined and segmented well enough to know about them. There are all sort of customers found in market, each of them are different in needs and wants, and their budgets and choices also differ, so to reach and fulfill their necessities market must be segmented and defined sufficiently.Is it possible to segment a market too far? What are the potential disadvantages of segmenting a market? Choose a market to provide examples of these potential disadvantages? Market segmentation is one of the best market strategies to apply and survive in market conditions. As in it product and services are enhanced and polished for the specific audience who demand, need and purchase them. It responds consistently to a given market stimulus. * It can be reached by market intervention in a cost-effective manner. * It is useful in deciding on the marketing mix. As itââ¬â¢s obvious that each an everything, strategy or planning have its own positive and negative side as well, so we can only try to minimize those disadvantages by research and investigations. Some of the disadvantages of over segmenting market are given below:- * The segment will be simply too small to be addressed economically or meaningfully. * Customers are misinterpreted on their needs by too much segmentation. As there is always competitor market segment also working in market which will increase the costs and lesser profit margin of your product. * Further segmenting introduce new products in market which need higher mass of advertisement to make its place in market, which will be needing lots of market research and risk as well because of new entry in market. The type of segmentation you use will depend on a lot of factors including the cost not only of conducting the research, but also of implementing the solution and the business impact.Consequently ideally for each segment or group you want to know what the economic value and the economic potential for each group is and have some idea as to whether this is increasing or falling. Consequently most quantitative segmentat ion studies are detailed and complex. A more cost-effective approach is to develop groups based on qualitative research. Typically a business wants to minimize the number of segments it has as each costs money to target properly (database marketing and digital printing techniques allow for far finer targeting without too much additional cost).With small numbers of big segments, a good researcher will be able to identify these groups within a programmer of qualitative research. This will not gather economic data, but it enables deeper insight into each group and, if monitored over time, provides core information about how segments change and develop. When it comes to prison sentencing there are a lot of trends to go from, probably the main outline you could say is the sentencing models these models are a basic outline of whatââ¬â¢s going to happen to an offender while being sentenced.These are the six options which include: capital punishment- for like murder offenders which includes the death penalty only in some states though, imprisonment -for those who commit violent crime and so forth usually sent to state or federal prison longer that one year, short term confinement -for minor offenders those petty crimes such as petty theft and so on normally less than a year served in county, intermediate sanctions- falls between probation and imprisonment which I would say is on the fence could go either way prison or probation which includes house arrest and electronic monitoring, then theirs probation which is a alternative of prison in which the offender is monitored within the community, and then theirs economic sanctions- which I would say an offender like this would be due to vandalism or something in that nature, in economic sanctions the offender is ordered to pay restitution or a fine for their crime.Pretrial diversion is a good system for offenders who are not constant offenders, for instance here in Odessa TX they have what I would call a pretrial diversion program which is called teen court and in teen court offenders for letââ¬â¢s say theft well instead of it going down in the records they chose to do some community service and avoid trial and a criminal record but this type of program is only offered to teens. For those who have the option of pretrial diversion it is a pretty good system which allows first time offenders in most cases to stay out of the system. Plea bargaining is a really good trend in sentencing, because plea bargaining is an agreement in which the defendant decides to plea guilty to the offense in return the defendant gets a lesser sentencing.Plea bargaining is a good system why because if the defendant pleads guilty to a lesser offense not only does it save time without having to go to court and the expenses they would have to put out their but most times if the defendant know that he or she did it and them pleading guilty to a lesser offense to cut back time in prison or probation most times they will take the bargain. Another great trend in sentencing is the three strikes laws which basically states that felons who commit three felonies are incarcerated for a very long time sometimes even life in prison this trend is good because most times it will keep repeat offenders from committing crimes I guess the thought of getting that third strike and going to prison for possibly life would be a really strong motivation to stay out of trouble and keep doing good.Then again this three strikes law could not be a good thing for instance in the text it talks about jerry Williams who had a record of two prior felony convictions involving violence when he stole p iece of pizza without a weapon from four children, then the judge under mandatory California law, had to sentence Williams to twenty five years in prison. I understand this man had a record and was on the verge of the third strike but I donââ¬â¢t think that sentencing Mr. Williams to twenty five years in prison for a pizza was really necessary that five dollar pizza now has cost the state an estimated 500,000 for the time that Williams is going to be incarcerated a simply being locked up for even a year in county would I think be more suitable and cost friendly in which saves the state a lot of money.Drug courts is also another great trend in sentencing because in drug court offenders who have had or have a problem with run in with the law due to drugs can choose to get help and drug court main goal you could say is to get the offender help and back into the community clean and on their way unlike traditional courts, drug court is not so much to punish the offender but to change the offender according to the text drug courts have proved very promising, and I would say a very good solution on handling a different kind of offender so that they wouldnââ¬â¢t have to go into a regular court and maybe receive six months or maybe even a worse sentence but trying to rehabilitate the offenders who need help and get them back into the community and on the right track. These trends that I listed are only a few that help the sentencing progress move along there are a lot more trends but these are only a few with a slight overview of how they operate and what goes on in the few trends that were listed.

High School vs College Essay A good education is an important part of oneââ¬â¢s life. To achieve a good education, one should attend both high school and college. Although some people think high school has a lot in common with college, I find them to be very different. After graduating from high school, I enrolled into college and noticed that there are many differences between them. A few of these differences include the amount of work given to the students, and the attitude and responsibilities of the teachers and students as well. First of all, high school is the first step to a higher level of learning. This place equips us with the proper knowledge needed in order to survive college and other higher levels of learning. The topics being taught in high school are generalized in basic Math, Science, English, foreign languages, and many other subjects. The students are more relaxed and their responsibilities are not that complicated and heavy in a sense that there are fewer requirements and their due dates are not immediate. High schools have been criticized for not giving enough homework or assignments to its students. The main contrast between the two educational institutions is the workload that is given to the students by the teachers. While I was attending high school, I could go days without having any homework during the entire week. High schools are characterized for assigning a single homework assignment or task per class or even per day. On other hand, there are many ways in which the attitudes of the teachers in high school differ from the attitudes of the teachers in college. In high school, the majority of the teachers seem to be stricter and have more rules for the students to follow. High school teachers are responsible for making sure each student obeys those rules to the fullest extent and carry out disciplinary ac tions for those who do not obey them. One example in which a teacher has taken on a disciplinary action was when students were tardy or skipped their scheduled class, the students usually received detention along with an F for the day. I have also noticed high school teachers have strict rules to obey given to them by a higher authority. These rules include no eating or drinking in class, and sometimes not even chewing gum. Another way in which the attitude of the teachers differ is that in high school the teachers seems to be more responsible for what they say and have to make sure they do not curse or say something that can offend a student. If a high school teacher offends a student, theà student has the privilege to complain to the principal, and most of the time the teacher has to take full responsibility. Furthermore, the attitude of students in high school and college also differs greatly in ways such as their dedication to schoolwork and to learning. High school students believe they most attend to class because they are being forced by the law or because their parents insist them to attend, and not because it helps for their future. The majority of high school students start the school year with excitement, but as the time goes, they become frustrated and bored. They begin questioning why they are in school, or what the purpose of doing homework is. While I was in high school, I had the opportunity to notice that many students prefer to goof during class time rather than doing their assignments. For the most part, high school students do not take their courses as seriously as they should. Moreover, there is always a class clown or someone tending to sleep, or even carrying a private conversation with other classmates during lectures. In contrast to high school, college is very specific and cautious about studying. In college, I was told by one of my instructors that a college student is expected to study for three hours a week, per credit. The subjects a student will learn and discuss are much more specific since you finally chose a career path you will take in the future. College students are notorious more mature, but also more responsible causing their workload to be more complex and heavier. Responsibility encourage changed for the simple fact that the curriculum is much more tedious and complicated due to the detailed topics that are discussed regarding your chosen career path. A college student may be given several tasks or homework assignment to do all that the same time for one class. For example, as a college student I have been given several pages to read from a text and a seven hundred word paper as well. Although colleges requires attendances and many of them try to enforce it; some teachers do not. While I am attending college, I am now able to see the difference between how there are some teachers who feel it is the students responsibility to come to class or not. If a student chooses to skip the class, the teacher will rarely say something to the student. However, even if colleges instructors are considered more flexible than any other teachers, students usually get an F for the day in which they are absents. Colleges provide a huge variety of freedom and independence to its studentsà because they believe students should be mature enough to make their own decisions on whether to attend a class or not. In contrast to high school teachers, college instructors are even able to say almost anything they want regardless of whether it offends someone or not such as in the occasion when a college instructor said, We dont need more black people around here during one of his lectures. By the time students get accepted at colleges, most of them already know their educational goals. Through my time spent in college I have realized students have the mindset to succeed in college because they want to be able to achieve their goals. People who decide to attend to college are working towards obtaining a higher level degree, and not just to play around on campus, or to waste their time pretending to pay attention. This is a higher level of learning, thus, requiring more time, and effort as well as devotion to studies. High school and college are very important in the educational processes because often one cannot get a good job without a well-developed education. This education frequently comes from having a high school diploma and a college degree. Although high school and college carry some of the same features; they also have several differences between them. The Dredd Scott Case The Dredd Scott case involved a landmark decision in the history of the Supreme Court, in the history of the United States the decision in this case was one of the most damaging statements in the history of the Supreme Court, involving the citizenship of a black person in the United States, and the constitutionality of the Missouri Compromise in 1820. The history of a black man named Dredd Scott states that he was a slave originally owed by a family by the name of Blow, which ended up selling him in 1833 to an army surgeon by the name of Dr. John Emerson of St. Luis. Due to his involvement as an army surgeon, Emerson was transferred to numerous places such as Rock Island, Illinois, Fort Snelling in the Wisconsin Territory then back to St. Louis in the end of 1838. Scott had accompanied Emerson throughout this period. Emerson had taken Scott to places that forbidden slavery according to the Missouri Compromise of 1820 and Scott was even allowed to marry during this! time period on fre e territory, his companion being a woman who was also a slave owned by Emerson. As Emerson and Scott had returned to St. Louis, a territory where slavery was legal, Emerson died and Scott was left to his widow, who eventually gave Scott back to his original owners, the Blows. Henry Blow, Scottââ¬â¢s original master, was opposed to the extension of slavery into the Western territories, and Blow lent Scottââ¬â¢s residence on free soil in Illinois and Wisconsin Territory had made him a free man. In 1846, Dredd Scott brought suit in the state court on the grounds that residence in a free territory released him from slavery. A lower state court had found to be in favor of Scott, but in 1852, the Supreme Court of Missouri ruled that upon his return to territory where slavery was legal, the status of slavery was reattached to him and therefore he had no standing before the court. The case was brought before the federal circuit court, which took jurisdiction, but held against Scott. The case was taken on appeal to the Supreme Court, where it was argued at length in 1855 and 1856 and finally decided in 1857. The decision handed down by a majority of the vote of the court was that there was no power in the in the existing form of government to make citizens slave or free, ! and at the time of the formation of the US Constitution they were not and could not be citi... ...than presiding over a session of the circuit court), Taney on the 28th of May, 1861, declared Merryman entitled to his freedom on the grounds that he was illegally detained. Taney stated that military detention of civilians like Merryman was unconstitutional because only congress had authority to suspend the writ of Habeas Corpus. Taney described the president as a mere administrative officer charged with faithful enforcement of the laws. according to the Chief Justice this amounted to a constitutional duty not to execute the laws "as they are expanded and adjudged by the co-ordinate branch of the government, to which that duty is assigned by the constitution." Taney sent a copy of his opinion to Lincoln. President Lincoln justified his action in a message to Congress in July 1861. He reasoned further that the framers did not intend that in an emergency no action should be taken to protect the public safety by suspending Habeas Corpus until Congress should be assembled. More importantly he ignored Taneyââ¬â¢s opinion. Merryman, however, was later released.

Interview With Middle School Principal Essay -- Interview Essays
An effective school leader possesses skills to create, implement, evaluate, improve and share a staff development plan. I met with Ben Rhodes, Sandy Creek Middle Schoolââ¬â¢s principal, to interview him on the specific elements of his yearly staff development plan. We began with the design process focusing on the district and school goals. District goals include improving literacy across the content areas in reading and writing, Guaranteed and Viable Curriculum (GVC). Guaranteed and Viable Technology (GVT), and Closing the Achievement Gap (Equity in Excellence). Using a variety of assessments to focus on specific needs, Ben Rhodes and Mary Sonya, our Pupil Achievement Specialist, examined CSAP, Explore, MAP, and RAD data. They use the Colorado Growth Model to help guide them to determine if students have made adequate yearly progress. Together, they created the plan that included the district goals mentioned above as well as continuing to include new technology skills, informatio n on special education changes with Response to Intervention (RTI), maintaining current staff implementation of literacy goals and a new goal of raising achievement in math. In deciding how to meet the skill needs of the teaching staff, Ben begins with the hiring process. Knowing what our School Improvement Plan goals are, his interview questions include specific skills and knowledge that will help Falcon Creek students meet these achievement goals. Mr. Rhodes is very clear about his high expectations of the teaching staff. He is currently in Denver Universityââ¬â¢s P.H. D. program in Educational Leadership and he utilizes his knowledge of best practice research. His assessments of staff learning needs are gleaned from a variety of sources that include feedbac... ...district trains staff with new technology tools that will include net books, mounted projectors, peripheral technologies, new student achievement reporting system (aka RAD and DAS systems running on Brio software, new access points, that centralizes the management console, so students and staff will be able to connect to the CCSD wireless network at all school sites. Training will also be provided to refine the RTI process. Using district and school goals, assessing needs using the right data, planning specific content and processes to teach best instructional practices, providing resources to ensure success, measuring success and providing frequent feedback, adjusting practices as needed to ensure successful implementation, evaluating and improving strategies and then sharing the plan with the community has been key to ensuring the highest student achievement.

Mexican-American Assimilation at the Turn of the 20th Century Essay
The first major wave of Mexican immigration during the twentieth century triggered physical as well as verbal attacks by white Americans. Immigrant labor camps were raided by whites espousing white supremacist beliefs. By 1911 certain politicians lobbied against further Mexican immigration. The Dillingham Commission argued that Mexicans were undesirable as future citizens. Nativist scholars and politicians feared ââ¬Å"mongrelizationâ⬠as a by-product of contact with Mexicans, and in 1925 a Princeton economics professor even spoke of the future elimination of Anglo Americans by interbreeding with Mexicans (Feagin and Feagin, p.265). These themes reemerged in 1928 when a congressional committee attempted to set limits on immigration from the western hemisphere. Congressman John Box called for restrictions on Mexican immigration because the Mexican was a product of mixing by the Spaniard and ââ¬Å"low-gradeâ⬠Indians. This mixture, according to Boxer, was an obstacle to participation in American democracy. The image of the Mexican American male possessing innate criminal tendencies emerged during the World War II era. For example, in 1943, following the Zoot Suit Riots, the Los Angeles Sheriffââ¬â¢s Department issued a report alleging that the Mexican Americanââ¬â¢s desire to spill blood was an inborn characteristic. Further, the report concluded that Mexican Americans were violent because of their Indian blood (Feagin and Feagin, 265). And as late as 1969, a California judge ruling in an incest case reiterated similar racist beliefs. He stated in court: ââ¬Å"Mexican people â⬠¦ think it is perfectly all right to act like an animal. We ought to send you out of this countryâ⬠¦. You are lower than animals â⬠¦ maybe Hitler was right. The animals in our society probably ought to be destroyedâ⬠(Feagin and Feagin, p. 266). One of the most persistent stereotypes is the image of simplemindedness. In 1982 the U. S. Department of Defense issued a report explaining that lower test scores for Hispanics and African Americans as compared to white Americans were due to genetic differences as well as cultural differences. During the same year, the National Educational Testing Service, surprised by the excellent performance of 18 Mexican American students attending Garfield High School (a school situated in one of Los Angelesââ¬â¢ poorest Mexican American communities), demanded that all retake the exam. Allegations of cheating by the students was the reasoning of the testing administrators. The students eventually did re-take the exam; once again they received excellent scores. Below the Line Sales Promotion
BTL sales promotion is an immediate or delayed incentive to purchase, expressed in cash or in kind, and having short duration. It is efficient and cost-effective for targeting a limited and specific group. It uses less conventional methods than the usual ATL channels of advertising, typically focusing on direct means of communication, most commonly direct mail and e-mail, often using highly targeted lists of names to maximize response rates. BTL services may include those for which a fee is agreed upon and charged up front. BTL is a common technique used for ââ¬Å"touch and feelâ⬠products (consumer items where the customer will rely on immediate information rather than previously researched items). BTL techniques ensures recall of the brand while at the same time highlighting the features of the product. Another BTL technique involves sales personnel deployed at retail stores near targeted products. This technique may be used to generate trials of newly launched products. It helps marketers establish one-to-one relationship with consumers while mass promotions, by definition, make it difficult to gauge consumer-response, except at the time of sales. Examples include tele-marketing, road shows, promotions, in- shop and shop-front activities, display units. The terms ââ¬Å"below the lineâ⬠promotion or communications, refers to forms of non-media communication, even non-media advertising. Below the line promotions are becoming increasingly important within the communications mix of many companies, not only those involved in FMCG products, but also for industrial goods. Below the line sales promotions are short-term incentives, largely aimed at consumers. With the increasing pressure on the marketing team to achieve communication objectives more efficiently in a limited budget, there has been a need to find out more effective and cost efficient ways to communicate with the target markets. This has led to a shift from the regular media based advertising. In other words, below-the-line sales promotion is an immediate or delayed incentive to purchase, expressed in cash or in kind, and having only a short term or temporary duration. Below the Line uses less conventional methods than the usual specific channels of advertising to promote products, services, etc. than Above the Line strategies. These may include activities such as direct mail, public relations and sales promotions for which a fee is agreed upon and charged up front. Trained sales personnel, often young women, are deployed at Retail Stores, near the shelves of targeted products. These young women convince customers visiting these shelves about the better aspects of their brand compared with others. This is ideal for new launches as it generates trials, which if successful result in repeat sales. In addition, above the line is much more effective when the target group is very large and difficult to define. But if the target group is limited and specific, it is always advisable to use BTL promotions for efficiency and cost-effectiveness. Say, for example, if a pen manufacturer is going to promote its product, it may take the ATL route, but if a company manufactures computer UPS, it will certainly take the BTL route, as the target group is very limited and specific. A Letter from Birmingham Jail
Reflection of ââ¬Å"A Letter from Birmingham Jailâ⬠by Martin Luther Kingjr. For our honors portfolio this quarter we were required to read three documents. We, then, were quizzed over each of the readings. First, we read ââ¬Å"Letter from a Birmingham Jailâ⬠by Martin Luther King, Jr. , then, we read the transcript of President John F. Kennedys inaugural address, and last but not least, we read ââ¬Å"Millennial Makeoverâ⬠by Morley Winograd and Michael Hals.Furthermore, we had to read and analyze the documents because the quizzes required us to think deeper than the written words on the paper. I believe these documents are critical because they have shaped the government and our society today. My favorite of these three documents, if I had to pick. would be ââ¬Å"Letter from a Birmingham Jailâ⬠, not only because I admire Martin Luther King Jr. , but also because this letter Is a very powerful and Inspiring piece of work.Luther wrote while being confined in a jail in Birmingham, Alabama, for participating in civil rights demonstrations. His letter states that he will continue resisting nonviolently against racial discrimination and pleads the readers to see segregation from a different point f view. Moreover, I noticed that he quoted many people including Apostle Paul, St. Augustine, Reinhold Niebuhr and many others. This made me realize that he most likely had the quotations memorized since he didn't have access to those sources while imprisoned.He mentions that ââ¬Å"injustice anywhere is a threat to Justice everywhereâ⬠and that ââ¬Å"an unjust law is no law at allâ⬠(Luther). This means that an unjust law causes harm; for example, If it Is lawful to torture a certain group of people, then that is not a law whatsoever. This idea of injustice affects many directly, ut also affects everyone else indirectly in the fact that prejudice is occurring around them. Furthermore, his words describe in detail what segregation was Ilke and what people like him had to go through.This impacted me because now, the idea of racial discrimination is completely frowned upon, while in the 1900's it was something that seemed right and normal. It took years of hard work, bloody massacres. and non-stop action to obtain equality and I hate to see that a little bit of racism still exists today. The idea that immigrants are taking away Jobs and opportunities that should be for U. S. citizens. surprises me because this country was founded and created by immigrants.Instead of seeing different countries and different people in one world, we should see the whole world as one, because every human being, no matter what race. has his/her own rights and should have the same opportunities that his neighbor does. Luther is one of the most charismatic and persuasive people in history and has not only inspired many, but also revolutionized a country's view. He wrote this letter hoping to stir up some emotion and I think he got his point a cross in very non-violent and mature kind of way that was unexpected and at the same time, admirable.His stance ofa nonviolent action and the desperate cry for an end to social discrimination is as powerful now as It was 50 years ago. We now stand by these liberal values and believe the God has made us all equal and has given us n r gnts tnat no law can take away. A tnougn tnls was not an easy project, I certainly did learn something from it and it inspired me to stand up for my beliefs, but also, in a way, allowed me to see that anything is possible through hard work.

Puberty Mini Essay There are many factors that affect the timing of puberty. A large factor is genetics, because it later causes the onset of other factors as well. Itââ¬â¢s said that maturation and puberty are determined by genetic forces and can be different depending on ethnicity as well. Children in the US seem to mature and hit puberty faster than Asian Americans, while African Americans are ahead of the US. Massimo Mangino, author from the Twin Research Department at King's, says: ââ¬Å"It is fascinating how common genetic variants influence both early puberty and weight gain. With that said obesity is another factor and is becoming an epidemic in this country. Obesity can almost guarantee the girl will have an early start into puberty and can later lead to a higher risk of psychological problems, risk-taking behavior, and even future breast cancer. But the opposite effect of obesity on pubertal timing may occur in boys. Studies have shown that early maturing boys seem to h ave a lower rate of obesity when compared with boys with normally or later timed puberty. Another factor is anxiety/stress.When there is a higher level of stress on the child it tends to prompt the body to send the hypothalamic signal and cause the child to reach puberty at a younger age than normal. Since this sends the child into early puberty, it can affect them with aggression and antisocial behavior as well later on. But on the other side of this, it can also delay puberty as well; it typically relies on the type of stress and the environment of the stress. If the living conditions are poor and there is little food, the stress can lead to a delay of maturation.Early puberty onset for females can be much more damaging than later onset. Females who start puberty early are at higher risk for problems and cancer later in life and usually have a negative body image as well. Earlier puberty onset for males is not as damaging as it is on females though. Sometimes it is seen as a head start in some cultures. If the male is strong and larger than his peers he is looked up to. Nevertheless, the Organization has instigated projects involving all the Central Asian states, such as the Caspian Sea-China highway that starts in Russia and crosses Astrakhan, rail connections, and the construction of hydroelectric power stations.However, despite the measures adopted by the SOC Business Council to strengthen linkages between the Central Asian states, government-to-government disagreements often delay their implementation. Several Khaki specialists also complain of the Co's inability to promote its economic strategies in business circles; some of its decisions are said to remain declarations of intent due to a lack of information among business leaders.. It is difficult to obtain a precise assessment of China-Astrakhan trade figures.The official statistics consider a little extent of cross-border trade, and cannot measure he amount of illegal trade, particularly in metals, or contraband, such as acetic anhydride, the chemical required to turn opium into heroin. Some local specialists point out significant differences between the Chinese and Khaki statistics. Thus, when Astrakhan claimed $550 million of trade with China in 1999, Beijing was already confirming more than $1 billion. In 2005, the discrepancy grew wider: Astrakhan, according to Stand, apparently achieved imports from China with a total value of $1. Billion, compared to almost $4 billion according to Beijing, and Stand reported exports to China worth nearly $2. Billion, exceeding t he Chinese figures by more than $500 million. The discrepancy can be attributed partly to political reasons: Stand seeks to overvalue its exports and undervalue Chinese imports in order to reduce a trade balance skewed too greatly in China's favor. In 2006, Astrakhan's trade deficit in relation to its neighbor was at least $1. 14 billion, 15 percent more than in 2005.On the other hand, the discrepancy can be explained by differences in accounting; Khaki businessmen have every reason to undervalue their trade flows in order to avoid taxes, unlike their Chinese counterparts, who receive tax concessions on exports. China's progress is so great that Beijing will soon catch up to Astrakhan's main trade partner, Russia. In 1992, China-Central Asia trade, two-thirds of which is China-Astrakhan trade, was barely $422 million, reaching $512 million in 1993. It plummeted in 1994 as a result of stricter visa processes, then rapidly climbed again, reaching $699 million 1997.It experienced a dec rease ($588 million) again as a result of the Russian economic crisis of the summer of 1998, which similarly affected Central Asia, then began to grow at a rate that seems unstoppable now. Trade passed $1 billion in 2000 before rising tenfold to more than $10 billion in 2006. The volume of trade tripled between 2002 and 2005, but continued to largely favor Chinese exports, which represented two thirds compared to Central Sais's one third. Thus, in 2006, China represented 15. 5 percent of Astrakhan's foreign trade (almost $9 billion), nearing Russian's 18. Percent (almost $11 billion). China's Trade Ministry quoted a figure of $10. 8 billion, which would put Moscow and Beijing on an equal footing, while Vladimir Paramount and Aliases Strokes add another $2 billion or more in illegal read, which would give China trade supremacy over Russia. More than 80 percent of China's exports to Astrakhan are finished consumer items (textiles, shoes, appliances, toys, electronics, spare parts, pharmaceutical products, foodstuffs), while 85 percent of Astrakhan's exports to China consist of raw materials (petroleum, ferrous and non-ferrous metals).In some sectors such as aluminum, the unidirectional nature of trade flows is impressive: more than 95 percent of Astrakhan. 1. 4 Research Purpose and Science Contribution . 4. 1 Purpose This thesis aims to bring some conclusion like how the Bilateral relations between the countries have proved to be mutually beneficial to both for strategic reasons. The two economies are highly complementary. This thesis has tried to figure out how China can help Astrakhan in many areas since it has a lot of experience in how to develop.And to successfully overcome the negative aftermath of the global financial crisis, also managed to significantly increase the volume of trade and economic cooperation. At the same time the thesis has tried to figure out the active aspects and threat that has arisen in Astrakhan side because of heavily depended on consuming Chinese products and not developing the self-sustainable producing and manufacturing culture. 1. 4. 2 Science contribution With these research questions in mind, the purpose of this dissertation is to investigate how China and Astrakhan will make a business in the future.Keywords: export, import, GAP, Trade, development, bilateral relation. 2 Content and methodology 2. 1 Main content In the research we will analyze the main problems in Trade between China and Astrakhan and how to solve it. Despite stability of trade and economic, more detailed analysis of the Astrakhan-Chinese cooperation revealed a number of the main problems in system of the bilateral economic relations. First, prevalence of a raw orientation in structure of commodity turnover of Astrakhan with China.The analysis of export-import streams shows that about 98% of the Astrakhan export to China are made by strategically important raw materials. The special attention in March, 2008 in Beijing a business forum ââ¬Å"Astrakhan -? China was paid to discussion of this problem: partnership for successâ⬠. In speech of the Prime minister of Astrakhan Karri Misaims it was noted that ââ¬Å"the structure of the Astrakhan export to the People's Republic of China keeps a pronounced survey orientationâ⬠.The main articles of the Astrakhan export to China - ? goods of survey group: hire of ferrous and non-ferrous metals, scrap metal, oil, and also raw leather, cotton raw, wool. Astrakhan imports from China finished goods, first of all, goods of routinely demand, mechanisms, electric equipment, production of transport mechanical engineering, etc. And the Chinese import to Astrakhan is hardhearted in most cases by goods of not high quality which competes with domestic producer owing to the low price and quantity.During the research we will prove or disprove all our assumption. The thesis will be divided into three parts: 1) The remainder of part I contains a review of the relevant literature, an introduction to the theories used to answer the research questions and a detailed description of the method. These sections focus on the research area and research approach, providing an overall context for the thesis. 2) Part II includes the main analysis of the research subject. ) Part Ill contains a conclusion and recommendations. It summarize s the key findings from the dissertation.It also includes a further scenarios and suggestions for future. 2. 2 Methodology and data The researcher approaches the object subjectively based on their prior understanding of the object. Therefore the authors have chosen the descriptive approach. The descriptive approach does not mean that the authors will find an absolute truth, but rather form an understanding of the investigated subject. This study does not aim to measure the exact phenomena; in contrast we aim to receive a greater understanding of bilateral trade.Since the purpose of this paper was not to find any absolute truths, this approach will give us more freedom to interpret the information we have collected based on the frames of references. We have chosen a qualitative approach in order to be able to collect detailed information from the secondary data regarding the topic. This is of great importance in order to sustain answer to our purpose. This will lead to a greater unde rstanding for their choices regarding our questions and enables us to discuss among those.According to Holmes and Solving (1997) a qualitative approach will help the authors to research the problem more closely and also provides opportunities to ensure validity and reliability of the study . The authors need to interpret and understand the usage of how the area of interest works and how it can be used. It is an advantage if those who will implemental research of qualitative approach have knowledge about the area (Patella & Davidson 2003). According to Barman and Bell (2007), there are researchers who are critical to the qualitative approach due to subjectivity. However, we have tried to be as objective as possible in our study .
